OVERVIEW

Welcome to MASS Monster. The terms “we,” “us,” and “our” refer to MASS Monster. MASS Monster operates the MASS Monster website, online store, and mobile application (collectively, the “Services”), including all related content, features, tools, products, and community functionality.

MASS Monster is powered by Shopify for e-commerce functionality. By accessing or using any part of the Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not use the Services.

SECTION 1 – ELIGIBILITY & ACCOUNTS

MASS Monster is intended for users age 13 and older. If you are under the age of majority in your jurisdiction, your parent or legal guardian must consent to your use where required by law. Nutrition features are strictly limited to adults age 18 and older.

You must have legal capacity to enter these Terms. Purchases by minors require authorization from a parent or legal guardian. By creating an account, you represent that all information you provide is accurate and complete.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Accounts may not be sold, transferred, or shared.

SECTION 2 – SERVICES & PRODUCTS

MASS Monster provides fitness-related digital content, community features, and physical products such as supplements, apparel, and training accessories.

Product descriptions and availability may change at any time without notice. Visual representations may vary depending on device and display settings.

SECTION 3 – ORDERS, PAYMENTS & REFUNDS

Placing an order constitutes an offer to purchase. Orders are not accepted until confirmed by us. Payments must be successfully processed before fulfillment.

Refunds and returns are governed by our Refund Policy, available on our website.

SECTION 4 – SHIPPING

Shipping times are estimates only. MASS Monster is not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss transfers upon carrier pickup.

SECTION 5 – USER-GENERATED CONTENT & COMMUNITY SAFETY (APPLE-REQUIRED)

The MASS Monster app includes community features and user-generated content (“UGC”), such as posts, comments, images, progress updates, or messages.

Zero-Tolerance Policy

MASS Monster maintains zero tolerance for objectionable content, including but not limited to:

  • Hate speech, harassment, or threats

  • Sexual, pornographic, or exploitative content

  • Violence or illegal activity

  • Bullying or abusive behavior

  • Impersonation or deception

Content Moderation

We actively moderate user-generated content. MASS Monster reserves the right to remove content or suspend or terminate accounts at any time, with or without notice, for violations of these Terms.

Reporting Objectionable Content

Users may report objectionable or abusive content directly within the app. All reports are reviewed by the developer.

Blocking Users

Users may block other users. Blocking immediately removes the blocked user’s content from the reporting user’s feed and prevents further interaction.

Enforcement Timeline

All valid reports of objectionable content are reviewed and acted upon within 24 hours, including content removal and account enforcement when appropriate.

SECTION 6 – USER RESPONSIBILITIES

You agree that you will not upload, post, or share content that violates these Terms, infringes on the rights of others, or violates applicable laws.

You are solely responsible for content you submit.

SECTION 7 – FEEDBACK & LICENSE

Any feedback, suggestions, or ideas you submit may be used by MASS Monster without compensation or restriction.

SECTION 8 – INTELLECTUAL PROPERTY

All content, branding, trademarks, designs, and software associated with the Services are owned by MASS Monster or its licensors and protected by intellectual property laws.

No license is granted except for personal, non-commercial use.

SECTION 9 – THIRD-PARTY SERVICES

The Services may include links or integrations with third-party services. MASS Monster is not responsible for third-party content, policies, or practices.

SECTION 10 – SHOPIFY RELATIONSHIP

E-commerce functionality is powered by Shopify. All purchases are made directly with MASS Monster. Shopify bears no responsibility for transactions or products.

SECTION 11 – PRIVACY

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

SECTION 12 – TERMINATION

We may suspend or terminate access to the Services at any time for violations of these Terms. Sections relating to intellectual property, liability, and indemnification survive termination.

SECTION 13 – DISCLAIMERS

The Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.

SECTION 14 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, MASS Monster shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.

SECTION 15 – INDEMNIFICATION

You agree to indemnify and hold harmless MASS Monster from claims arising out of your use of the Services or violation of these Terms.

SECTION 16 – GOVERNING LAW

These Terms are governed by the laws of the United States and the state in which MASS Monster operates.

SECTION 16A – NUTRITION, AI & COACH FEATURES

Nutrition features are available only to adults age 18 and older. Nutrition targets, calorie and macro estimates, workout-day adjustments, progress reviews, and adaptive proposals are educational planning tools, not medical advice, diagnosis, or treatment. Deterministic calculations and food data are estimates and may be incomplete or inaccurate. You remain responsible for reviewing entries, portions, ingredients, allergens, and targets before relying on them.

Camera and voice tools are designed to help you log a useful estimate quickly. Their output is always an editable draft and is never a promise of visual calorie accuracy. Photos and audio may be temporarily processed by OpenAI to create a draft, and food searches may use USDA FoodData Central. We request that OpenAI not store Responses API output for product history, but provider abuse-monitoring content may still be retained for up to 30 days. Temporary source media is deleted after processing under our stated retention practices; confirmed entries and their provenance remain until you delete them, delete a range, or delete your account.

If you grant a verified coach access, the grant may include the Nutrition, bodyweight, training, accountability, and review categories listed at confirmation. Grants last for the displayed period, are checked on every access, and may be revoked immediately by either party. Coach access is audited. Excluded categories include chats, billing, purchase information, locations, story media, and AI source files.

Nutrition analytics are limited to content-free product events and aggregate counts. They do not contain food names, calories, macros, weights, coach identifiers, photos, or transcripts. Available exports, consent choices, retention periods, revocation, and deletion rights are described in our Privacy Policy.

SECTION 17 – CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of changes.
